1. Acceptance of terms

By accessing or using Goggy, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the service.

2. Description of service

Goggy is an AI-powered conversational tool that connects to your sports and health data and helps you understand it through natural language chat, primarily via WhatsApp. The service is currently in early access / beta. Features, pricing, and availability may change at any time — see Section 10.

3. Eligibility

You must be at least 16 years old to use Goggy. By using the service you confirm you meet this requirement.

4. Account responsibilities

• You are responsible for maintaining the security of your account credentials
• You must provide accurate information when creating your account
• You may not share your account with others
• You are responsible for all activity that occurs under your account

5. Acceptable use

You agree not to:

• Use Goggy for any unlawful purpose
• Attempt to reverse-engineer, scrape, or copy the service
• Use Goggy to harm, harass, or deceive others
• Provide false data or impersonate another person
• Attempt to circumvent usage limits or access controls
• Use the service in a way that places unreasonable load on our infrastructure

6. AI-generated content disclaimer

Goggy uses third-party AI models (including those from Anthropic, OpenAI, and Google) to generate responses. You acknowledge that:

• AI-generated responses may be inaccurate, incomplete, or outdated
• Responses are based on the data available in your connected accounts and the AI model's interpretation of that data — errors in either can lead to incorrect outputs
• You should not rely solely on Goggy's responses to make decisions about your training, health, or nutrition
• Goggy is a tool to help you understand your data, not a replacement for professional coaching, medical, or nutritional advice

7. Health and medical disclaimer

Goggy provides information based on your training data for informational and educational purposes only. It is not a medical device and does not provide medical advice, diagnosis, or treatment recommendations. Always consult a qualified healthcare professional before making decisions about your health, training load, or nutrition — particularly if you have any existing medical condition or injury.

8. Third-party data and service dependencies

Goggy's functionality depends on data from and connectivity to third-party platforms including Garmin, Strava, Apple Health, Oura, Whoop, and WhatsApp. You acknowledge that:

• The accuracy of Goggy's responses depends on the accuracy and completeness of data synced from your connected apps. We are not responsible for errors, omissions, or delays in data from those platforms.
• Goggy connects to WhatsApp via Meta's official API. If Meta restricts or changes that API, the WhatsApp functionality of Goggy may be affected or discontinued. We will notify users of significant changes but cannot guarantee continued WhatsApp availability.
• Access to third-party platforms may be revoked by those platforms at any time. Goggy is not liable for loss of service resulting from such actions.

9. Data and privacy

Your use of data within Goggy is governed by our Privacy Policy, which forms part of these Terms. By using Goggy, you consent to the data practices described therein.

10. Beta service and changes

Goggy is currently in early access / beta. This means:

• The service is provided on an "as is" basis and may contain bugs or errors
• Features may be added, modified, or removed without prior notice
• Pricing may change before the general release. Early access users who lock in a founding price will be notified in advance of any changes that affect them.
• We may discontinue or significantly change the service during the beta period with reasonable notice

11. Intellectual property

All content, code, branding, and materials on the Goggy platform are the property of the Goggy team and may not be reproduced, distributed, or used without prior written permission.

12. Subscriptions and billing

• Free plan: no payment required
• Pro plan: billed monthly or annually as selected at the time of purchase
• Cancellations take effect at the end of the current billing period; no partial refunds are issued
• Refunds are available within 14 days of initial purchase if you have not used the Pro features

13. Limitation of liability

To the maximum extent permitted by applicable law:

• Goggy is provided "as is" without warranties of any kind, express or implied
• We do not guarantee uninterrupted, error-free, or secure service
• We are not liable for any loss or damage arising from your reliance on AI-generated responses
• We are not liable for any loss or damage arising from the inaccuracy of data imported from third-party platforms
• Our total liability to you for any claim is limited to the amount you paid us in the three months preceding the claim

14. Termination

We reserve the right to suspend or terminate accounts that violate these Terms, with or without notice. You may delete your account at any time by contacting us at info@askgoggy.com. Upon termination, your data will be handled in accordance with our Privacy Policy.

15. Governing law

These Terms are governed by European Union law. Upon formal incorporation, these Terms will be updated to specify the exact jurisdiction. Any disputes will be resolved through good-faith negotiation first; failing that, through the courts of the country in which Goggy is incorporated.

16. Changes to these terms

We may update these Terms from time to time. We will notify you by email at least 14 days before material changes take effect. Continued use of the service after changes take effect constitutes acceptance of the revised Terms.
